BusinessMCP Hub Terms

These terms govern the BusinessMCP Hub: the Data API, the Hub MCP endpoint, and the tools sold through them. They add to our Terms of Service, which continue to apply, including their disclaimers and limitation of liability. Where the two differ on the Hub, these terms win.

The service

BusinessMCP, Inc.(“BusinessMCP”, “we”) sells access to data tools per call, as REST endpoints and as MCP tools, through an API key issued to your workspace. Some tools are ours (“first party”); others are supplied by third parties through our marketplace (see below). The tools, their inputs and their prices are listed on the Data API pages and in the reference.

Prepaid balance and billing

  • Every tool has a price in US dollars per call, or per item for a bulk tool, shown on the Data API pages and returned with every call. The Hub is prepaid: each call is paid from your account’s balance when it runs. There is no subscription and we do not invoice usage afterwards. A call your balance does not cover is refused, not charged later.
  • You add balance by buying a pack through Stripe, as a one-time payment: $10 ($10 of balance), $50 ($55 of balance, +$5 bonus (10%)), $200 ($240 of balance, +$40 bonus (20%)), $1,000 ($1,300 of balance, +$300 bonus (30%)). Prices exclude taxes, which are added where they apply.
  • Bonus balance is a discount on future calls. It has no cash value, cannot be transferred and is never refunded or paid out.
  • Purchased balance does not expire while your account is active. It is tied to your workspace and cannot be transferred to another account or exchanged for cash.
  • If a pack payment is refunded, or reversed through a dispute or chargeback, we remove the whole balance that pack added, bonus included. If you have already spent it, your balance can go below zero, and paid calls are refused until it is back above zero.
  • A call is charged when it runs. It is refunded to whichever of trial or balance paid for it when the tool fails, and for tools priced per result, when nothing is found. Input that fails validation is never charged. You may set a monthly spend limit on any key; a call that would exceed it is refused, not partly charged.
  • Hub billing is separate from any BusinessMCP plan. Cancelling a plan does not refund Hub balance, and buying balance does not change your plan.

Free trial

  • A new account can receive a one-time trial of $5 of usage, which ends 7 days after it is granted. Any part left unused then lapses. It has no cash value.
  • The trial starts when you save a payment card. Saving the card does not charge it, and the trial never turns into a charge.
  • The trial pays for our first-party tools only. It never pays for people data or for marketplace tools.
  • One trial per person and one per card. At most 3 trials start from the same network in any 30 days, and disposable email addresses cannot start one. We may refuse or withdraw a trial obtained by getting around these limits.

Acceptable use

  • Do not copy, scrape or resell the data you receive as a dataset or a service that competes with ours. Using results inside your own product and workflows is what the Hub is for.
  • Do not use any result to discriminate unlawfully against anyone, or to decide anyone’s eligibility for credit, employment, insurance, housing or any other purpose covered by the US Fair Credit Reporting Act. The Hub is not a consumer reporting agency and its data is not a consumer report.
  • Do not contact, or keep contacting, anyone who has opted out, with us or with you.
  • Do not probe, overload or try to get around rate limits, caps, key scopes or the controls on any tool, and keep your keys secret.

People data

Some tools return records about individuals in their professional capacity. What those records are and where they come from is on our data-broker disclosure. Before your first people call you accept this section and declare your purpose, one of: b2b sales prospecting; b2b marketing to business contacts; recruiting outreach (not screening or eligibility); updating my own crm records; verifying a business contact.

  • Use people records only for the purpose you declared, and only for a legitimate business-to-business purpose. None of the permitted purposes is an eligibility decision.
  • Honour opt-outs. Remove a person from your use when they ask you to, and do not re-add them from our data. We filter every result against our own suppression list, and you must not work around it.
  • You are responsible for how you contact people, including compliance with CAN-SPAM, the TCPA, CASL and any other law that applies to you, and for any notice you must give them.
  • We never return records about people we place in the EU, the EEA, the UK or Switzerland, about people we place in California, Texas, Vermont and Oregon, or about people we cannot place (in the United States, in a state). Do not try to obtain those records through the Hub.
  • An account may receive up to 500 people records a day unless we agree a higher limit.
  • We log every disclosure: which records went to which account and key, when, and for what declared purpose. We may use the log to answer regulators and the people concerned.
  • We may suspend people access, or your account, if we reasonably believe these rules are being broken, and we may do so without notice where people could be harmed.

Marketplace tools

Third parties supply some tools. Each tool shows a trust tier: first party (ours), verified (a seller with a verified domain whose server we reviewed) or reviewed(a no-code tool that passed our review). Nothing is listed without our review, and we can suspend any tool at any time. A seller’s own unreviewed tools are visible to that seller only.

We are the merchant of record: you buy balance from us, and every tool, ours or a seller’s, is paid from that one balance. Marketplace tools are paid from purchased balance only. A marketplace tool’s output comes from its seller. We screen it, but we do not guarantee it, and the disclaimers in our Terms of Service apply to it as they do to ours.

Selling on the Hub

  • Sellers are paid through Stripe Connect and must complete Stripe’s onboarding. You set a price per call in US dollars, from $0.001 to $10. You keep 70% of your list price on every call a buyer pays for, and we keep 30%as our platform fee. Your share is of your list price, whatever pack the buyer used, so a buyer’s bonus balance never reduces it.
  • Earnings for a call become payable 14 days after the call, and are paid on the 15th of the month once your balance reaches $25.00.
  • If a call is refunded, you earn nothing for it. If the payment that funded calls to your tool is refunded or lost in a dispute, we may deduct the matching earnings, from unpaid earnings first and otherwise from future payouts.
  • You warrant that you have the right to offer your tool and its data, that it does what its listing says, and that it complies with the law. You must not use a buyer’s inputs for anything except answering their call. We may suspend a tool that fails, changes its behaviour or breaks these terms.

Suspension, changes and liability

We may suspend a key, a tool or an account that breaks these terms or puts people or the service at risk. We may change these terms and our prices; we will tell accounts that hold balance by email before a material change takes effect, and you will be asked to accept a new version before your next people call. Our Terms of Service govern warranties and liability, and their disclaimers and limitation of liability apply to the Hub.
